ORDER OF THE BOARD (by C.A. Manning):

On June 6, 2002, the Board, at the parties’ request, extended until August 12, 2002, the
time period within which the Illinois State Toll Highway Authority (Authority) may appeal an
April 9, 2002 determination of the Illinois Environmental Protection Agency (Agency).
    See

    415 ILCS 5/40 (a)(1) (2000),
    as amended
    by P.A. 92-0574, eff. June 26, 2002; 35 Ill. Adm.
Code 105.406. The Agency denied part of the Authority’s request for reimbursement from the
Underground Storage Tank Fund regarding a leaking underground storage tank at the
Authority’s maintenance facility M-5 located on I-90 at mile post 11 in Rolling Meadows,
Cook County. Because the Authority failed to timely file an appeal, the Board dismisses this
    case and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the
Board adopted the above order on August 22, 2002, by a vote of 7-0.

    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
