    ORDER OF THE BOARD (by G.T. Girard):
    On June 11, 2002, the Board received a motion to strike “the second affidavit of
    Warren Weritz” (Motion to Strike Affidavit) filed by respondent. On June 20, 2002 a motion
    to strike the Motion to Strike Affidavit was filed by the complainant. Respondent filed a
    response to complainant’s motion to strike on June 26, 2002.
    The Board denies the complainant’s motion to strike the Motion to Strike Affidavit as
    the Board finds that material prejudice could occur to the respondent if the Board does not rule
    on the substance of the Motion to Strike Affidavit. The Board will allow the complainant until
    August 15, 2002 to respond to the Motion to Strike Affidavit.
