SUPPLEMENTAL OPINION AND ORDER OF THE BOARD (by J. Marlin):
This matter comes before the Board on a Motion for
Reconsideration filed by Ekco Glaco Corporation (Ekco) on
December 19, 1986. The Illinois Environmental Protection Agency
(Agency) filed a Response on January 2, 1986. In its motion,
Ekco requests that the Board modify its Opinion and Order of
November 20, 1986 which had granted Ekco a variance from 35 Ill.
Adm. Code 215.204(j)(l) and 215.205 until January 1, 1987.
Specifically, Ekco is seeking that the variance granted by the
Board on November 20, 1986 be extended until February 15, 1987.
Ekco states that it will not be in compliance by January 1, 1987
due to delays and complications it has encountered in the
procurement and installation of volatile organic material (VOM)
control equipment. However, Ekco asserts that its compliance
plan will be completed by February 15, 1987. In its Response,
the Agency states that it has no objection to extending the
variance until February 15, 1987 and that it fully expects Ekco’s
afterburner to be installed and operating by that date. In light
of Ekco’s good faith efforts toward attaining compliance and the
fact that in this instance no environmental impact will result
from the 45—day variance extension, the Board will grant Ecko’s
motion to modify the Board’s Order of November 20. Therefore,
Ekco’s variance shall extend until February 15, 1987.
ORDER
The Board hereby modifies its Order of November 20, 1986 in
this matter to read as follows:
The Board hereby grants Ekco Glaco a variance from 35 Ill.

Agency adequate to demonstrate that the operation of
that line is in compliance pursuant to the internal

35
Ill. Adm. Code 215.207.
