This matter comes before
the Board upon a January
6,
1987
letter
filed on behalf of
Sours Grain Company which was written
in response
to
the Board’s December
5,
1986 Order.
That order,
which was entered based upon 35 Ill.
Adm. Code 101.107(c),
required
Sours
to
submit
various
information
regarding
materials
which have been submitted
to the Board by Sours and which
Sours
requested be kept confidential.
In
its January
6 letter, Sours
requests that the Board not
make a confidentiality determination “pursuant
to Section 101.107
at
this time”,
stating that
it
waives
its
right
to
a
determination of
its claim
at this time “consistent with prior
Board practice and with
35 Illinois Administrative Code Section
120.203.”
Given
that hearings have been completed and
no other
requests have been made,
and
in the interests of administrative
economy, the Board hereby vacates its December
5,
1986 Order and
will
hold the submitted materials as confidential until such time
as further
action becomes necessary due
to a request for
the
information or upon further Board order.
However, this action
should not be construed
as implying that the Board views this
confidential material as
within the purview of Section 120.203.
