ORDER OF THE BOARD

This matter comes before the Board upon the October
16,
1986
response of the Illinois Environmental Protection Agency
(“Agency”)
to the remedial plan offered by the Eastwood Manor
Water
Company (“EMCO”).
Cheryl Lockwood
(“Lockwood”)
submitted
a
response
to EMCO’s plan on November
18,
1986.
The Board
issued
a decision
in this matter on March
14,
1986.
The Board’s Order of that date required EMCC
to,
inter
alia,
submit within 90 days
a written plan addressing remedial actions
to be
undertaken
in each of the areas which resulted
in
violation
of the Illinois Environmental Protection
Act or
the Board’s regulations.
The Board received EMCO’s remedial plan on June
10,
1986.
As part of
its March 14,
1986 Order, the Board also required
the following action
on
the part of the Agency:

After
receipt of (EMCO’s)
remedial plan,
the
(Agency)
shall, within
90 days after receiving
such plan, submit a response
to
the plan.
The
response may,
in the Agency’s discretion, contain
any revisions which
the Agency determines
to be
necessary in order
to prevent the occurrence of
future violations
on the part of Eastwood Manor
Water Company.
The Board withheld
final disposition of this
matter, pending receipt of the remedial plan and
the Agency’s comments,
if any, regarding
it.
The remedial plan submitted by EMCO reads
in full as
follows:
Regarding Counts
I and
II EMCC will perform the following action:
A.
EMCO will inject a polyphosphate chemical into the water
at
the
Lincoln Road pumping station
to “sequester
the
iron con”
to maintain the
iron content within the
maximum allowable concentration of lppm.
This treatment
was
installed September
3,
1985 and
is controlling
the
red water problem.
Occasional flushing
on dead
end
mains
and portions of the distribution system that has
flow reversals is still
a company policy.
B.
Inject
a liquid bleach chemical into the water system at
the Country Lane and Lincoln Road pumping station
to
maintain the required chlorine level.
The Country Lane
pumping station
is on automatic standby only and comes
on when pressure drops to
25.
Water
from this well
contains some sulfur which will
be controlled through
chlorination.
C.
Tastes
in
the water
in the area of the Kuck residence
will
be controlled through more frequent
flushing as
Mr. Kuck
is on
a dead end.
Begarding Count III
Regarding this count
the company will notify all customers
in the future promptly
in the event that the water
fails
to meet
the
1.0 mg/l max. allowable concentration for
iron.
Regarding Count IV
Regarding this count
the company will
issue boil orders
whenever the water pressure
falls below 2opsi
in the water
system.

Regarding Count V
Regarding
this count the company will notify the Agency
whenever
the safety of the water supply
is endangered or when it
becomes necessary to
issue
a boil order.
THE AGENCY’S SUGGESTED ADDITIONS TO EMCO REMEDIAL PLAN
The Agency’s response
to EMCO’s remedial plan lists several
additional
actions which
the Agency believes need
to
be added
as
required elements of the plan in order
to prevent EMCO from
committing
future violations.
These
suggested additional actions
are
as follows:
1.
EMCO shall completely flush
its distribution mains three
times per year
(early spring, mid summer and late
fall)
in order
to remove iron sediments from the system.
2.
Dead ends shall
be flushed
as frequently as necessary to
result
in the maintenance
of 0.5
ing/l chlorine residual
in these dead ends.
3.
EMCC shall
continue
to inject chlorine
at the Country
Lane and Lincoln Road pumping
stations and shall
test
chlorine residual
at each well daily.
EMCO shall adjust
the pumps
as necessary
to maintain approximately
1.0
mg/l residual
chlorine.
4.
EMCO ~hall improve controls
at Lincoln Road pumping
station
so that the pumping capacity is sufficient to
keep the
tank full.
The tank shall
be kept
full except
when there
is danger
of
its freezing,
in order
to reduce
the number
of incidents of low water pressure and
outage.
5.
EMCC shall
keep records
of the
following information
and
shall submit those records
to the Agency with its
monthly operating
reports:
a.
Daily records of chlorine injected, chlorine
residual and water
pumped
at each well.
b.
Results of monthly chlorine residual sample
at each
of the dead ends.
(The Agency
is aware
of three
dead ends on this system.)
c.
Daily record
of the amount of phosphate solution
injected at the Lincoln Road well.
d.
Copy of continuous pressure recording chart
(located
at the elevated water
tank).

The Board
finds
that the Agency’s suggestions are
appropriate measures
for assuring the efficacy and legality of
EMCO’s operations.
For those reasons,
the Board orders
that the
additional actions proposed by the Agency in its October
16,
1986
response
be
integrated,
in full, into EMCO’s remedial plan.
The Lockwood response
to the EMCO remedial plan essentially
concurs with the Agency’s recommendations,
but seeks
the addition
of
several other requirements
to it.
Specifically, Lockwood
seeks:
1.
Notification by EMCO to her, and
to the other customers
of the system,
at least three days
in advance of
flushing
of
the distribution mains.
2.
The specification of
a date certain by which EMCO is
to
improve controls at
the Lincoln Road pumping station,
and delineation by the Agency as
to how to best improve
the controls.
3.
Maintenance by EMCC of the
following records, as well
as
submission of them
to the Agency concurrently with the
submission of monthly operating reports:
a.
records of
all flushing of distribution mains and
dead ends
b.
records
of all complaints by customers.
4.
That EMCO be required
to maintain
the records referenced
in
item
5
of the Agency response and number

(above)
in
such
a manner that they may be available
for inspection
by EMCO customers during normal business hours.
The Board
finds that certain of Lockwood’s suggestions
warrant addition
to
the EMCO remedial plan.
Notification
to the
systen’’s customers by EMCO at least three days
in advance
of
distribution main flushing,
and planned maintenance and
submission
to the Agency of records relating
to the flushing of
mains as well
as dead ends, are hereby added
by the Board
to the
remedial
plan.
The
Board concludes that Lockwood’s other
suggestions cannot and/or should not be integrated
into the plan
and therefore will
not be.
Lockwood’s November
18 filing additionally alleges that EMCO
has yet
to pay the $1,000 penalty assessed
it by Board
Order of
March 14,
1986.
The Board’s July 11,
1986 Order
set
a deadline
of August
4, 1986
for payment of the penalty.
The Board
specifically requests Agency confirmation of this charge
and
notification
to the Illinois Attorney General
so that,
if true,
appropriate
action may be taken
in furtherance of collecting
the
penalty.

Finally the Board reminds EMCO that, pursuant
to the Board’s
March
14,
1986 Opinion and Order,
the company must implement the
provisions of the plan within six months of the date of this
Order.
This constitutes
Board
final action
and
this docket
is
hereby closed.
