INTERIM ORDER OF THE BOARD (by J. Anderson):
On September 2, 1986, the Parties submitted a stipulated
settlement agreement.
It appears that either the issuance of a RCRA permit or the
equivalent of a federal RCRA ~delayed compliance orders may be
necessary to effectuate the agreement. In any event, it appears
that this proceeding is subject to the procedural requirements of
the Board’s RCRA procedural rules 35 Ill. Adm. Code 103.260—
103.268. Pursuant to these rules and Federal RCRA authorization
requirements, the proposed agreement is defective.
The parties are directed to address these issues.
Alternatively, the parties are directed to inform the Board as to
a) why these procedures do not apply and b) whether this
agreement is consistent with the closure and post—closure
requirements of 35 Ill. Adm. Code Parts 724 and 725.
If no response to this Order is received within 60 days, the
stipulation will be rejected and this matter will be set for
hearing.
