CONCURRING OPINION (by B, Forcade):

I concur in today’s decision to send the majority’s

conceptual ideas regarding an emergency rule out for a brief

public comment, I continue to totally disagree that there is an

adequate basis for an emergency rule, I continue to totally

disagree with nearly every substantive provision of the proposed

emergency rule, My objections have been detailed in my

dissenting opinions of June 11, 1986, and October 2, 1986, To

conserve paper, time and limited mailing resources, I will not

repeat those objections here,
