OPINION AND ORDER OF THE BOARD
(by J.D. Dumelle):
This provisional variance request comes before the Board
upon
an April
29, 1987 recommendation of the Illinois
Environmental Protection Agency (Agency).
The Agency recommends
that
a thirty
(30) day provisional variance be granted
to Olin
Hunt Specialty Products,
Inc.
(Olin Hunt),
pursuant to 35 Ill.
Adm. Code 722.134(b)
to allow Olin Hunt to store twenty—five
(25)
drums of hazardous waste on—site after expiration of its ninety
(90) day storage limit on April
15,
1987.
After investigation of Olin Hunt’s request,
the Agency
concluded that the
twenty—five
(25) drums of hazardous waste must
remain on—site for longer than the ninety
(90) days due to
unforeseen,
temporary, and uncontrollable circumstances and that
compliance with the accumulation time requirements of
35 Ill.
Adm. Code 722.134 would impose
an arbitrary or unreasonable
hardship.
The Agency recommends that the provisional variance be
granted from April
15, 1987
to May 15,
1987.
Pursuant to Section 35(b)
of the Act,
the Board hereby
grants the provisional variance as
recommended.
This Opinion
constitutes
the Board’s findings of fact and conclusions of law
in this matter.
ORDER
Olin Hunt Specialty Products, Inc.,
is hereby granted
a
provisional variance pursuant to
35 Ill.
Adm. Code 722.134(b)
to
store twenty—five
(25) drums of hazardous waste from April
15,
1987
to May
15, 1987.
