ORDER OF THE BOARD (by C.A. Manning):

On March 7, 2002, the Board, at the parties’ request, extended until June 14, 2002, the
time period within which Marlena Mackie (Mackie) may appeal a January 31, 2002
determination of the Illinois Environmental Protection Agency (Agency).
    See
    415 ILCS 5/40
(a)(1) (2000); 35 Ill. Adm. Code 105.406. The Agency denied part of Mackie’s request for
reimbursement from the Underground Storage Tank Fund regarding a leaking underground
storage tank at Pete’s Marathon, 539 South Poplar, Centralia, Marion County. Because
Mackie failed to timely file an appeal, the Board dismisses this case and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the
Board adopted the above order on June 20, 2002, by a vote of 7-0.

    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
