ORDER OF THE BOARD (by J.D. Dumelle):
On April 1, 1987, the Ecko Glaco Corporation (Glaco) filed a
petition to extend a prior variance. Glaco requests that the
Board extend and modify the variance granted on January 8, 1987,
for a new pan line from February 15, 1987 until November 1,
1987. Glaco further requests that the Board extend and modify
the variance for the used pan line from June 27, 1986 until April
1, 1988. The Board finds that the April 1, 1987, petition for
variance extension is deficient in that it fails to include:
1) any indication as to whether the Board may grant the
requested relief consistent with the Clean Air Act (42
U.S.C. 7401 et seq.) and the Federal regulations
adopted pursuant thereto (i.e. whether the requested
extension conflicts with the Clean Air Act’s compliance
deadline of December 31, 1987) as required by 35 111.
Adm. Code 104.122;
2) a detailed description of the existing and proposed
equipment or proposed method of control to be
undertaken to achieve full compliance with the
Environmental Protection Act and regulations, including
a time schedule for the implementation of all phases of
the control program from initation of design to program
completion and the estimated costs involved for each
phase and the total cost to achieve compliance, as
required by 35 Ill. Adm. Code 104.121(f); and
3) an explanation as to the necessity of the April 1, 1988
compliance date in light of the offset to be provided
by the new pan line scheduled for compliance on or by
November 1, 1987.
