ORDER OF THE BOARD (by B.. Forcade):

On April 8, 1987, Arlington Park Racetrack, Ltd. (“APR”)

filed a petition for variance from certain water quality and

NPDES permit regulations. That petition is deficient in that:

1.. The petition fails to specifically re-

quest or specifically waive hearing as

required by 35 Ill. Adm Code 104.121; and

2~ The petition seeks relief from nearly 30

water quality standards yet fails to

demonstrate that each of those standards

might be violated absent Board variance..

Unless an amended petition is filed within 45 days of the

date of this Order, curing the above—rioted defects, this matter

will be subject to dismissal.

APR is also requested to clarify whether the requested

termination date of the variance is May 31, 1989..
