By
its Opinion and Order of January
22,
1987,
the Board
granted
the City
a variance
from the January
1,
1986 deadline
date of
35
Ill. Adm.
Code
306.373,
to enable the City
to file
a
petition for exception
to the combined
sewer overflow
(CSO)
regulations
on or before July
1,
1987.
The purpose of
the
variance was
to allow the City
to collect data concerning
its CSO
problems
and their environmental
impact.
On June
25,
1987,
in response
to
a motion by the City
to
which the Agency did not object,
the Board extended the July
1,
1987 filing date
through October
1,
1987.
On September
21,
1987,
the City again moved
for an extension
of
the deadline from October
1,
1987
to February 15,
1988.
In
support thereof,
the City asserts:
The complexity
of
the
sewer
systems, pump stations
and overflow points has contributed
to
a difficult
assignment
to
collect
the
field
data.
Obtaining
valid
flow
data,
representative
samples
and
good
analytical
results
is
always
difficult
but
even
more
so
in the complicated Ottawa system.
Rainfall
events have not occurred
in
the right
intensity and
with
satisfactory
precedent
conditions
to
produce
the
best
mathematical
model
input
for
the
First
Flush
determination.
Due
to
the
severe
time
constraints
the
consultants
are
attempting
to
use
the data
that
is
available but cannot complete the
analyses
of data and formulate
the recommended plan
of implementation for the City of Ottawa’s approval
by the current October
1,
1987,
deadline.
The City proposes
to file the report
of
its consultant with
the Agency on
or
before December
15,
to allow
the Agency
to

determine whether
it will join with the City as
a co—petitioner,
and
to allow time
for finalization of
a CSO petition before
the
February 15, 1988 proposed filing date.
On October
16, 1987,
the Agency filed
a
response stating
that it had
no objection to the grant
of
the requested extension.
While this
is
the second request for extension
of
the
original variance,
the Board hereby grants the City’s motion,
as
there
is
no
indication that the City has been less than diligent
in
its pursuit
of
information with which
to support its
petition.
However,
the Board trusts that
there will
be no need
for further
requests for extension.
The City’s variance
is
extended through February
15,
1988.
