    ORDER OF THE BOARD (by J. Marlin):
    On November 2, 1987, Illinois Power Company (Illinois Power)
    and the Illinois Environmental Protection Agency (Agency) filed a
    Joint Motion for Remand of the Contested Permit and Stipulated
    Permit Conditions. This motion was also presented at hearing
    which was held on November 24, 1987. Specifically, the motion
    requests that the Board remand this matter back to the Agency
    with the order that the Agency amend the permit, it previously
    issued to Illinois Power, such that the amended permit will be
    consistent with the stipulated permit conditions. The stipulated
    permit conditions are the result of settlement discussions held
    between Illinois Power and the Agency.
    The Board hereby remands this matter back to the Agency.
    However, the Board is not taking a substantive position with
    respect to the stipulated permit conditions.
    IT IS SO ORDERED.
