ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon a June 10, 1987,
Motion to Consolidate filed by LTV Steel Company (“LTV”). LTV
requested the Board to consolidate the action in PCB 87—68, an
appeal from the denial of an application for renewal of an
operating permit, with the action in PCB 86—43, an appeal of
certain conditions imposed in an operating permit. Because the
underlying permit in both actions is the same and because the
substantive issues are the same, LTV seeks consolidation. In its
June 15, 1987, response, the Illinois Environmental Protection
Agency (“Agency”) supported the motion for consolidation. The
Agency believes that the specific circumstances in this case
favor consolidation, and that no good purpose would be served by
keeping the two actions separate.
Based on the foregoing, the Board hereby grants the motion
to consolidate, and directs the Clerk to consolidate these two
actions.
