ILLINOIS POLLUTION CONIROL BUARD
September 17, 1967
PFIZER PIGMENTS, INC.
Petitioner,
v.
)
PCB 67—110
ILLINOIS ENVIRONMENTAL
PROTECTICL~ AGENCY,
Respondent.
ORDER OF ThE BOARD (by 3.C. Dumelle):
On July 30, 1987, Pfizer Pigments, Inc. filed a Petition for
Extension of Variance. On August 6, 1987, the Board found the
petition deficient and granted leave to Pfizer to file an amended
petitioner within 45 days. Pfizer filed an amended petition on
September 14, 1987. The Board notes that Pfizer amended the
original petition to delete the incorporation by reference of the
record from the prior proceeding but failed to include
information that may have been in that record that is necessary
to perfect the amended petition. The Board therefore finds that
this amended petition is deficient in that it fails to include:
(1) estimated costs for each phase of the control
program from initiation of design to program
completion and the total cost to achieve
compliance, pursuant to 35 Ill. Adm Code
104.121(f); and
(2) an indication as to whether the Board may
grant the relief requested consistent with
federal law, pursuant to 35 Ill. ~dm Code
104.122(b).
Unless an amended petition is filed within 45 days of the
date of this Order, curing the above—noted defects, this matter
will be subject to dismissal.
IT IS SO ORDERED.
