    ORDER OF THE
    BOARD (by C.A. Manning):
    On November 13, 2000, the parties filed a joint notice of extension of the 35-day period
    to appeal a decision of the Illinois Environmental Protection Agency regarding the imposition of
    conditions on a permit which became effective October 5, 2000.

    The Board hereby grants
    petitioner an extension of the time period for filing an appeal in the matter until January 3, 2001,
    pursuant to Section 40(a)(1) of the Environmental Protection Act (415 ILCS 5/40(a)(1) (1998)).
    Because the Board has timely received a joint notice of extension, the Board extends the appeal
    period to the aforementioned date. The Board will dismiss this matter and close the docket if
    petitioner fails to file an appeal on or before that date.

    above order was adopted on the 16th day of November 2000 by a vote of 7-0.

    The permit by its terms states that it becomes “effective upon withdrawal of permit appeal
    docketed PCB 00-214.” On September 26, 2000, petitioner filed a motion to voluntarily dismiss
    that permit appeal. On October 5, 2000, the Board granted the motion and closed the docket.
