This matter comes before the Board on the October 13, 1987

Petition of Frantz Manufacturing Company requesting a variance

from 35 Ill. Adm. Co5e 304.120, 304.124. The Petition is

deficient in the following manner:

1. The Applicant fails to request or waive hearing;

2. The Petition fails to include proof of service on

Illinois Environmental Protection Agency;

3. The Petition fails to include the City of Sterling as a

party.

Unless the Board receives an Amended Petition curing the

above noted deficiencies within 45 days this action will be

subject to dismissal.
