    INTERIM ORDER OF THE BOARD

    By today’s Order, the Board
    is requesting Central Illinois
    Public Service Company (“CIPS”) and the Illinois Environmental
    Protection Agency
    (“Agency”)
    to provide additional factual
    information and legal analysis regarding the above—captioned
    matter.
    CIPS indicates that stack tests conducted
    in October,
    1974,
    showed compliance with an emission limit
    of 55,555 lbs SO2/hr
    (R.
    21).
    Cli’s also presented evidence that
    a 1986 stack test exceeds
    that value and the permit
    limitation needs
    to be increased
    to
    65,194 lbs S02/hr
    for CIPS
    to comply.
    The record does not
    disclose what changes precipitated this increase
    in SO2
    emissions,
    when those changes occurred and what the
    regulatory
    impact
    of those changes might
    be.
    Specifically,
    the Board requests
    the
    following questions be
    addressed:
    1.
    What
    changes
    occurred
    to
    increase
    SO2
    emissions and when did they occur?
    2.
    Do
    those
    changes,
    including
    the
    1981
    switch
    to
    Monterey
    Coal,
    constitute
    a
    “modification” or “major modification” as
    those
    terms are used
    in Section lll(a)(4)
    of
    the
    Clean
    Air
    Act
    or
    40
    CFR Section
    51.18 or
    40 CFR Section 51.24?
    3.
    Do
    the
    increased
    emissions
    trigger
    the
    prevention
    of
    significant
    deterioration
    provisions
    of
    Part
    C
    of
    the
    Clean
    Air
    Act?
    The Board orders that not later than September
    21,
    1987,
    CIPS and the Agency shall file written responses
    to these
    questions.

    In addition, CIPS indicates that there
    is
    a present dispute
    with the United States Environmental Protection Agency
    (USEPA)
    which
    led
    to
    a notice of
    violation
    (R.
    14,
    22).
    The Board orders
    that CIPS
    advise the Board of the present status of that
    controversy and provide copies
    of any documents or correspondence
    between CIPS and USEPA relating to that dispute.
