This matter comes before
the Board upon
a March
2,
1987
filing
of an Administrative Citation pursuant to Section 31.1
of
the Illinois Environmental Protection Act
(Act)
by the Illinois
Environmental Protection Agency (Agency).
The Agency alleges
that Milo Lambert and Charles
E.
Fitzpatrick, Respondents,
violated Sections 2l(p)(5),
2l(p)(l2.)
and
21(p)(ll) of the Act.
The statutory penalty established
for each of these violations
is
$500 pursuant
to Section 42(b)(4)
of the Act.
Respondents filed
a petition for review on April
2,
1987.
On July
2,
1987,
Respondents filed
a motion
to dismiss,
stating
that they desire that the petition be withdrawn and that this
matter
be dismissed.
On July
15,
1987,
the Agency filed
a motion
to join Respondent’s motion.
Apparently the Respondents had
previously acknowledged two of the violations and had paid
$1,000.
On July 2,
1987,
the date Respondent’s filed
thei.r
motion
to withdraw, Respondents paid the remaining $500
penalty.
As the Agency states that all pending matters have been
satisfied,
the motions are granted and this proceeding
is
dismissed.
It
is hereby ordered that, unless
the penalty has already
been paid,
within 30 days of the date of this Order Milo Lambert
and Charles
E.
Fitzpatrick
shall,
by certified check or money
order payable to the State of
Illinois and designated
for deposit
into the Environmental Protection Trust
Fund, pay a penalty
in
the amount of $1,500 which
is
to be sent
to:
Illinois Environmental Protection Agency
