ORDER OF THE BOARD (by B. Forcade):
On July 13, 1987, Lustour Packaging Corporation (“Lustour”)
filed a petition for variance from 35 Ill. Adm. Code 215.405,
Compliance Dates and Geographical Areas, for two years. That
petition is deficient in that it fails to provide:
A detailed description of the existing and
proposed equipment or proposed method of
control to be undertaken to achieve full
compliance with the Act and regulations,
including a time schedule for the implemen-
tation of all phases of the control program
from initiation of design to program com-
pletion and the estimated costs involved for
each phase and the total cost to achieve
compliance.
Lustour’s intentions (in paragraph f, page 6) to monitor,
develop and re—evaluate compliance options does not constitute a
compliance program, especially since further research work on
water—based coatings has been terminated (paragraph h, page 7)
and add—on controls have been repudiated (paragraph k, page 9).
Unless an amended petition is filed within 45 days of the
date of this Order, curing the above—noted defect, this matter
will be subject to dismissal.
