The Board,
in its R88—7
First Notice proposal adopted
this
same day,
ha-s proposed comprehensive design, performance and
reporting requirements
for all landfills,
including those on—site
“Section 21(d)” facilities exempt from the requirement
to have
a
permit.
The record developed in the predecessor Docket R84—17
(as well as
in R84—22, Performance Bonds)
highlight
a problem
which could not be addressed
in those dockets:
the undisputed
fact that the Agency lacks even the most fundamental
information
regarding the location of permit—exempt on—site operations as
well as the type of non—hazardous waste which they treat,
store,
or dispose.
The Board believes that its regulatory activities,
as well
as the environmental oversight responsibilities of the
Agency, would be enhanced by a “census” of such facilities.
The
Board has chosen
to use the term “census”
to distinguish
such
information from the comprehensive reporting requirements
proposed for landfills.
This Docket is accordingly opened for the purpose of
directing the staff of the Board
to prepare
a draft census
proposal
in proper regulatory format.
Staff
is directed to
consider,
and develop for inclusion,
as appropriate, definitions
and response requirements sufficient to elicit basic information
including:
1)
The location of the “on—site” operation;
2)
The identity of the person whose wastes are stored,
treated, or disposed within the site where such wastes
are generated;
3)
The type of waste generated;
4)
Whether
the “on—site” operation is
a waste—storage,
waste—treatment or waste—disposal operation;
5)
The period of time the operation has been conducted;
and

6)
The
identification of permits
(e.g. NPDES permits),
it
any, issued by the Agency related
to the conduct of the
operation.
The Board has no information leading
it
to believe that
providing such information would
be technically infeasthle or
econoTnically unreasonable.
In any event,
the Board
believes it
should consider proposing such
a census requirement.
