On March
9,
1987,
the City of Morris
(Morris)
filed
a motion
to extend the time
for
filing
its brief
on the CSO Exception
petition.
The motion was granted by Hearing Officer
Order
entered March
13,
19S7,
and Morris was granted until March
16,
1987,
to file its brief.
The Illinois Environmental Protection
Agency
(Agency) was scheduled
to file
its brief
on
or before
March
30, 1987.
However,
the Board has received
no filings
in
this case since
the date
of
the Hearing Officer’s Order.
Despite
the foregoing,
the Board was prepared
to proceed
with
a decision based
on
the existing record.
This case was
placed
on the July
16,
1987, Board Meeting Agenda for discussion
with
a view toward ultimate decision
at
the August
6, 19~7Board
Meeting.
On August
3,
1967, however,
the Board was informed
by the
Agency via
a telephone conversation that Morris had recently
submitted
to the Agency
a new Compliance
Plan.
The Agency stated
that
it needed time
to review this new information and
to
evaluate
its position with respect
to this proceeding.
It
appears,
therefore,
that
a Board decision on August
6,
1987,
would
be premature
in light of this new information.
However,
the Board must
be apprised of the current status of this
proceeding.
The parties
are requested
to submit status reports,
which include
the parties’ intentions
as
to the ultimate
resolution
of this matter,
to the Board
on
or
before October
6,
1987.
