104.121 requires that
certain data be
contained
in
a Petition For Variance.
Respondent has correctly
pointed
out that
the Petition did not contain
the following:
1)
A detailed description
of the method
to be
undertaken
to achieve compliance.
2)
An explanation of costs
associated with other
coating
methods,
for instance,
eletrostatic spraying and
dipping.
3)
Sufficient data
to determine whether
the requested
permit can be
issued consistent with
federal
law.
If
an amended petition curing
the above
noted defects
is
not
filed within
45 days,
this proceeding will
be subject
to
dismissal.
