ORDER OF THE BOARD (by J.D. Durnelle):
This matter comes before the Board upon an August 31, 1987,
motion to dismiss administrative citation filed by tne Illinois
Environmental Protection Agency (Agency). The Agency states that
the Respondent has covered the site with dirt to a depth
acceptable to the Agency and plans to seed for cover. Also, the
Respondent has restricted access to the Site by blocking the site
entrance road and has posted the site “No Trespassing” and “No
Dumping” The Agency states that the site as remediated poses no
threat to the environment of the State of Illinois or to its
citizenry. The Agency concludes that further enforcement action
is not warranted in light of the immediate and responsive
remedial measures taken by the Respondent. The Agency,
therefore, moves for dismissal.
The Agency’s motion is hereby granted and this matter is
dismissed.
