    OPINION AND ORDER OF THE BOARD
    (by J.D. Dumelle):
    This matter comes before
    the Board upon the Illinois
    Environmental Protection Agency’s
    (Agency) filing of
    its
    Recommendation concerning Petitioner’s request
    for
    a provisional
    variance from
    35
    Ill. Adm. Code 722.134(b),
    which prohibits the
    on—site accumulation
    of hazardous waste
    in excess
    of
    90 days.
    The Agency recommends that Petitioner
    be allowed
    to temporarily
    store hazardous wastes on—site from February
    12,
    1988
    to March
    13,
    1988.
    After
    investigation,
    the Agency concludes that the wastes
    must remain on—site for longer than the ninety
    (90)
    days due
    to
    unforeseen,
    temporary and uncontrollable circumstances;
    and that
    compliance with the accumulation time requirements would
    impose
    an arbitrary or unreasonable hardship.
    The Agency recommends
    that the provisional variance
    be granted from February 12,
    1988
    until March
    13, 1988.
    Pursuant to Section
    35(b)
    of the Act,
    the Board hereby
    grants the provisional variance as recommended.
    This Opinion
    constitutes the Board’s findings
    of fact and conclusions of law
    in this matter.
    ORDER
    Taracorp Industries,
    is hereby granted
    a provisional
    variance pursuant to
    35
    Ill. Adm.
    Code 722.134(b)
    to store
    twenty—five
    (25)
    drums of hazardous waste from February 12, 1988
    to March
    13,
    1988.
