    INTERIM ORDER OF THE BOARD (by J. Anderson):
    On February 19, 1988, the Village of Lake Villa (Lake Villa)
    petitioned for variance from the treatment plant operator
    certification requirements for the type or size of Lake Villa’s
    sewage treatment plant (STP).
    The contents of the petition are insufficient. In reference
    to the Board’s procedural rules 35 Ill. Mm. Code 104.121, Lake
    Villa is ordered to provide the following information:
    1) Is the Board correct in assuming that Lake Villa is
    requesting variance from the 35 Ill. Mm. Code 312.101
    Prohibition?
    2) What is the length of time, giving the specific date,
    for which the variance is requested?
    3) When does Lake Villa anticipate that its present Class 3
    operator will receive Class 2 certification?
    4) What are the details of the agreement entered into by
    Lake Villa with a “neighboring Village”? Identify bhe
    Village and the relationship between the variance relief
    sought and the terms of the agreement?
    5) Clarify and specify regarding the in—house and
    contractual operator, in terms of function, time and
    dollars that will be spent or saved, what Lake Villa
    means or intends to do when it states:
    Using an outside conLractor is costly
    when our present operator could qualify
    with a variance, so the funds could be
    used for improvements versus wages.

    All records and data will be monitored
    and we will have a qualified operator on
    stand—by for a more supervisory control.
    6) How long has Lake Villa been operating without a Class 2
    operator? Give Lake Villa’s past efforts to comply,
    including costs incurred and results achieved.
    7) Give supporting factual information why there will be no
    environmental impact should variance be granted. How
    long has the STP been on critical review, and why; what
    have been the environmental effects?
    Unless an amended petition is filed within 45 days of the
    date of this Order, curing the above—noted defects, this matter
    will be subject to dismissal.
