ORDER OF THE BOARD (by B. Forcade):
The Petitioners, Ron Criley, individually and as Mayor of
the City of Troy, Illinois, and the City of Troy, (‘tPetitioners~)
petition to intervene in an appeal from a denial of a landfill
siting approval by the Madison County Board (“County Board”) on
an application for landfill siting approval from GSX Corp. for
the expansion of the Barton Landfill site in that county. The
Petitioners allege that the County Board did not entertain their
petition to intervene in the County Board proceedings in this
matter. The Petitioners request leave to intervene in any
proceedings before this Board in this matter or, alternatively,
that this Board remand this matter to the County Board with
instructions that the County Board conduct an additional hearing
that would include ev dence to be submitted by the Petitioners.
GSX Corp. has not yet filed an appeal of the County Board Denial
with this Board.
The Board will temporarily docket this filing as PCB 88—49
for the purpose of clarification of the issues involved. The
parties are hereby directed to brief, by April 22, 1988, the
issue of the authority of this Board to hear this matter in the
absence of some indication of a final decision of the County
Board and a subsequent appeal by an appropriate party. The Clerk
of this Board is hereby directed to serve a copy of this Order
together with the Petition on the Madison County Board and GSX
Corp.
