ORDER OF THE BOARD (by B. Forcade):
On February 22, 1988, the Dow Chemical Company (“Dow”) filed
a petition for variance
,
seeking relief from certain air
pollution control regulations. That petition is deficient in that
it fails to contain a plan for ultimate compliance with the Act
and Board regulations. The intention to file a future proposal
for regulatory relief does not constitute an adequate compliance
plan. In addition, Dow does not specify the term for which
variance relief is sought.
Unless an amended petition curing the above defects is filed
within 60 days of today’s Order, this matter will be subject to
dismissal.
