    ORDER OF THE BOARD (by J.D. Dumelle):
    This matter comes before the Board upon an Amended Petition
    for Variance filed by Scott Air Force Base (Scott) on May 17,
    1988. The Amended Petition was filed in response to Board Order
    dated April 21, 1988, requesting additional information. The
    Amended Petition responded to each issue raised in the Board
    Order; however, the affidavit required by 35 Ill. Adm. Code
    104.124 was not submitted. ~t its regularly scheduled Board
    Meeting on May 19, 1988, the Board adopted an additional
    information Order, requesting the affidavit. Petitioner
    submitted the affidavit on May 23, 1988. The May 19, 1988
    additional information Order is therefore rescinded
    The Board today, at a Special Meeting accepts Scott’s
    Amended Petition for Variance and defers decision until an Agency
    recommendation is served upon the Petitioner and is filed with
    the Board. The Board notes that the statutory 120 day decision
    period begins today with the filing of the affidavit.
