ILLINOIS POLLUTION CONTROL BOARD
February 25,
1988
LAWRENCE BROTHERS,
INC.,
Petitioner,
v.
)
PCB 87—180
ILLINOIS ENVIRONMENTAL
PROTECTION AGENCY,
Respondent.
INTERIM ORDER OF THE BOARD
(by J.
Anderson):
On February 17,
1988,
the Environmental Protection Agency
(Agency) filed
an appeal
of
the Hearing Officer’s Order which
set
the location of the March
2,
1988 hearing at
the offices
of
the
Petitioner.
The Agency seeks
to have the hearing
“reset
for
hearing
in a public place.”
(Agency appeal,
p.
3).
The Board grants
the Agency’s appeal, and instructs
Hearing
Officer
to re—schedule
the hearing consistent with this Order.
The Board emphasizes
that
it shares the Hearing Officer’s
concerns about
the Board’s decision deadline;
even though the
Petitioner
has extended the decision deadline from April
21,
1988
to June
16,
1988,
the Board notes
that the Hearing Officer
has
little time leeway for relocating and re—scheduling another
hearing consistent with
the timeframes set out for hearings that
must
be re—noticed.
IT
IS SO ORDERED.
J.
Marlin dissented.
