    ORDER OF THE BOARD (by J. Anderson):
    This provisional variance request comes before the Board
    upon an April 22, 1988 Recommendation of the Illinois
    Environmental Protection Agency (Agency). The Agency recommends
    that a 30—day provisional variance be granted to Shell Oil
    Company pursuant to 35 Ill. Adm. Code 722.134(b) and Section 37
    of the Illinois Environmental Protection Act, to allow Petitioner
    to store certain hazardous wastes longer than the 90—day limit.
    The Agency has found that due to unforeseen, temporary and
    uncontrollable circumstances, it would cause an arbitrary and
    unreasonable hardship if the Board did not grant the requested
    provisional variance.
    The Board hereby grants Petitioner a 30—day provisional
    variance pursuant to 35 Ill. Adm. Code 722.134(b) from March 21,
    1988 to April 20, 1988.
    IT IS SO ORDERED.
    Board Members J.D. Dumelle, R. Flemal and 3. Marlin were not
    present.
