    ORDER OF THE BOARD (by J.D. Durrtelle):
    This matter comes before the Board upon the March 22, 1988
    filing by Illinois Environmental Protection Agency (Agency) of
    its “Agency Recommendation” in the above—captioned provisional
    variance.
    Petitioner has requested that it be granted variance from
    the requirements of 35 Ill. Adm. Code 304.124(a). Petitioner
    requested that a 20 mg/i limitation be imposed during the period
    of the variance. The Agency has determined that the higher iron
    effluent level will have minimal environmental impact on
    receiving streams and that compliance with the Act would impose
    an arbitrary and unreasonable hardship.
    Accordingly, Petitioner is granted a provisional variance
    from the iron effluent levels of 35 Ill. Adm. Code 304.124(a)
    subject to the following:
    a) Variance shall begin when the contractor resumes work to
    regenerate the stored resins, and continue for 45 days
    or until the work needed to regenerate the demineralizer
    resins is completed, whichever occurs first.
    b) Effluent discharge from Outfall 001(a) shall be limited
    to 20 mg/i for iron as a 30 day average during this
    variance period.
    c) Petitioner shall notify Jan Hopper of the Agency’s
    Compliance Assurance Section via telephone at 217/782—
    9720 when the regeneration work is started and when it
    is completed. Written confirmation shall then be
    submitted within 5 days to:

    d) Petitioner shall during the term of the variance sample,
    analyze and report for iron from Outfall 001(a).
    Reports must be submitted with Petitioner’s DMR’s.
    e) Petitioner shall operate and maintain its wastewater
    treatment facilities so as to produce the best effluent
    possible during this variance period.
