ORDER OF THE BOARD (by N. Nardulli):

This matter comes before the Board on a petition for

expedited decision filed on behalf of the respondent in the

above—captioned matter. In the petition, the respondent note

that it did sign an open waiver as to the statutory decision

deadline in this matter. However, it now feels that the delay in

the decision is working a hardship on the applicant and the

county by denying the residents of Wabash County of the

availability of a landfill. The movant prays that the Board

render a decision by May 11,, 1989.

The Board notes that at the time the petition for expedited

decision was filed in this matter, the Opinion and Order had

already been scheduled for discussion at the Board’s April 27,

1989 meeting and was tentatively scheduled for decision at its

May 11, 1989 meeting. In response to the petition for expedited

decision, the Board hereby agrees to endeavor to expedite the

decision making process in this matter and will issue the Opinion

and Order at the earliest possible date.
