    ORDER OF THE BOARD (by T.E. Johnson):
     
    On May 20, 2002, the petitioner filed a motion to withdraw the appeal in this matter.
    In the motion, the petitioner represents that it has been in negotiation with the Illinois
    Environmental Protection Agency (Agency) and no longer wishes to pursue this matter. The
    petitioner requests that the Board grant its motion to withdraw the appeal and dismiss this
    matter. To date, the Agency has filed no response to the motion. Pursuant to Section
    101.500(d) of the Board’s procedural rules, if no response is filed to a motion within 14 days
    after service, the party will be deemed to have waived objection.

    101.500(d). The petitioner’s motion to dismiss is granted, and the docket is closed.
