    ORDER OF THE BOARD (by C.A. Manning):
     
    On May 2, 2002, the Illinois Environmental Protection Agency (Agency) timely filed
    an administrative citation against Barbara Buck (Buck).
    See
    415 ILCS 5/31.1(c) (2000); 35 Ill.
    Adm. Code 108.202(c). The Agency alleges that Buck violated Sections 21(p)(1) and (p)(3) of
    the Environmental Protection Act (415 ILCS 5/21(p)(1), (p)(3) (2000)). The Agency further
    alleges that Buck violated this provision by causing or allowing the open dumping of waste in a
    manner resulting in litter and open burning at a facility located in the Southeast Quarter of the
    Northeast Quarter of Section 32, Township 20 North, Range 2 East in DeWitt County.
     
    However, the Agency states, in a June 4, 2002 motion to dismiss, that it failed to serve
    the administrative citation on Buck within “60 days after the date of the observed violation.”

    dismisses this case and closes the docket.
