ORDER OF THE BOARD (by B. Forcade):
On January 21, 1988, Ekco Glaco filed a motion for rehearing
in this matter, asserting that the Board’s December 17, 1987,
conclusion to deny variance relief is contrary to the evidence,
unfounded, and the product of twisted reasoning. Ekco Glaco
provided new facts to demonstrate that it has a firm compliance
plan and is diligently pursuing compliance. Ecko Glaco urges the
Board to reconsider and reverse its decision.
On February 2, 1988, the Illinois Environmental Protection
Agency filed a response to that motion
,
asserting the Board’s
decision was correct. The Agency asserts that the new facts
should not be considered and that if they are considered they
demonstrate that the only “firm” compliance date in the original
proceeding has now been abandoned by Ekco Glaco.
Ekco Glaco has not provided a persuasive case for
reconsideration. The motion for rehearing is denied.
