ORDER OF THE BOARD (by J. Theodore Meyer):
On April 1, 1988, the Board received a letter from counsel
for respondent Daubs Landfill, Inc., pointing out a discrepancy
in the briefing schedule. The Board’s March 24, 1988 Order
refers to final filings in this matter as due no later than April
14, 1988. However, at the conclusion of the March 25, 1988 Board
hearing, the Hearing Officer established a briefing schedule
under which petitioners’ brief is due April 11 and respondents’
briefs are due April 25. Daubs seeks clarification of this
divergence.
The April 14 date referred to in the most recent Board Order
is based upon a statement in the Board’s February 4, 1988 Order
setting this matter for hearing. The February 4 Order states
that briefing shall be completed as expeditiously as possible,
but no later than 70 days from February 4, which would be April
14. Since the parties have agreed to the schedule set by the
Hearing Officer, the Board will not now change that schedule.
However, it must be pointed out that the filing of the final
brief on APril 25 will not leave the Board much time for
deliberation before the May 19, 1988 deadline for decision of
this case.
