PROPOSED RULE.
FIRST NOTICE.
PROPOSED OPINION AND ORDER OF THE BOARD

This matter comes before the Board upon
a regulatory
proposal
filed by the Illinois Environmental Protection Agency
(Agency) on October
20,
1988.
The Agency proposes amendments
to
35
Ill.
Adm. Code 211 and 243
in order
to adopt
a PM10 ambient
air quality standard
for particulate matter.
The Board adopts
the Agency’s proposal
for First Notice today
to cause publication
of
the proposal
in the Illinois Register so that affected persons
are made aware of the proposal.
As public hearings are yet to be
held,
the Board will not at this time take a position on the
merits of
the Agency’s proposal.
For
its “statement of reasons”
to support
the proposal,
the
Agency stated:
Sections
108
and
109
of
the
Clean
air
Act
authorize
the
United
States
Environmental
Protection
Agency
(“USEPA”)
to
review
and
revise
the
health
and
welfare
criteria
upon
which
the
national
primary
and
secondary
ambient
air
quality
standards
(“NAAQS”)
are
based.
On
July
1,
1987,
USEPA~ promulgated
revisions
to the NAAQS
for particulate matter
(52 Fed.
Reg.
24634).
The
use
of
the
“total
suspended
particulate
matter”
(“TSP”)
indicator
for particulate
matter was
replaced
by
an
indicator
that
includes
only
those
particles
with
an
aerodynamic
diameter
less
than
or
equal
to
10
micrometers
(“PM10”).
A
primary
24-hour
PM10
standard
of
150
micrograms
per
cubic
meter
(ug/rn3)
with
no
more than one exceedance per year was adoptec~,
as
was
an
annual
PM10
standard
of
50
ug/m
,
expected
annual
aritimetic
mean.
Secondary
standards
identical
to
the
primary
standards
in all respects were also adopted.
The Agency
has,
therefore,
proposed
that
these
PM10standards
be
adopted
as
Illinois

standards,
suitable
for
utilization
in
the
Illinois State Implementation Plan
(“SIP).
The Hearing Officer
is directed
to schedule hearings and
to
provide
for pre—filing of testimony and exhibits so as
to
effectuate an efficient information gathering process.
ORDER
The Board hereby proposes for First Notice the following
amendments
to 35 Ill. Adm.
Code 211
and 243.
The Clerk
is
directed
to submit the proposed amendments to
the Secretary of
State
for publication
in the Illinois Register.

concentration of

exceeded

per year.
