ORDER OF THE BOARD (by J.D. Dumelle):

This matter comes before the Board upon the June 10, 1988,

Agreed Motion For Extension Of Time To Respond To Board Order,

filed by Petitioner, Sours Grain Company. The Motion states that

the parties are engaged in on—going negotiations and the parties

would prefer a 30—day extension in which to respond to this

Board’s May 5, 1988 more—information Order.

The Board notes that Petitioner has requested a hearing in

this matter; thereby requiring a final Board decision within 120

days. The Board construes Petitioner’s request as a 30—day pro

tanto waiver of the statutorily imposed decision deadline;

thereby extending by 30 days the deadline for final Board action.

The Motion is granted; Petitioner’s response is due on July

20, 1988.
