ORDER OF THE BOARD (by J.D. Dumelle):

This matter comes before the Board upon Petitioner’s May 5,

1988 Motion To Expedite Hearing. The Motion requests this Board

to expedite hearing on Coal City’s Petition For Variance. The

Board notes that at paragraph 40, p. 16, of the Petition For

Variance, Petitioner waived hearing in this matter. Given this

apparent incongruence, the Board construes the May 5, 1988 Motion

For Expedited Hearing as a motion for expedited decision

Hearing has been waived. Petitioner is cautioned that if this

was not its intent it must notify this Board, in writing, within

15 days of the date of this Order.
