ORDER OF THE BOARD (by N.J. Melas):
On July 7, 2000, the City of Elgin filed a petition for an adjusted standard. The Board subsequently
determined that the petition did not adequately address certain proof required by Section 28.1(c) of the
Environmental Protection Act (415 ILCS 5/28.1(c) (1998)) and certain informational sufficiency requirements
required by the Board’s rules at 35 Ill. Adm. Code 106.705. The Board set a September 25, 2000 deadline for filing
    the amended petition. See
    In re
Petition of City of Elgin (August 10, 2000), AS 01-1.
On September 22, 2000, petitioner filed a motion for extension of time to file the amended petition for an
adjusted standard. Petitioner stated that its counsel and consultant were occupied with another matter. The Board
grants the motion and directs petitioner to file the amended petition no later than October 10, 2000. Failure to file
the amended petition by that date will result in dismissal of this matter.
If petitioner files the amended petition, with the proper proof and requirements, by October 10, 2000, the
Board will accept this matter for hearing. The Illinois Environmental Protection Agency shall file a response to the
amended petition within 30 days after it is filed with the Board. See 35 Ill. Adm. Code 106.714(a).
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that the above order was
adopted on the 5th day of October 2000 by a vote of 7-0.
