ORDER OF THE BOARD
(by J.D. Dumelle):
This matter comes before the Board upon the June
2, 1988,
Joint Motion To Stay Proceedings Pending Settlement.
The Motion
asks this Board
to stay any and all proceedings
for
30 days
pending finalization of
a settlement agreement between the
parties.
Ultimately
the Motion requests
a stay
of proceeding
through Friday,
July
1,
1988.
The Motion
is granted.
However,
the parties should note
that
in
a matter such
as this the Illinois General Assembly has
imposed
a 120—day decisional deadline.
Because this
is
a Joint
Motion and because no open waiver has been received,
the Board
construes this Motion as
a 30—day,
pro tanto waiver;
thereby
extending
the deadline
for final decision
for the 30 days
requested in the Motion.
IT
IS SO ORDERED.
I, Dorothy
M. Gunn,
Clerk
of the Illinois Pollution Control
Board, hereby certify
that ~e
