    ORDER OF THE BOARD (by J.D. Dumelle):
    This matter comes before the Board upon the July 22, 1988
    filing of a Motion To Dismiss by Petitioner, Illinois
    Environmental Protection Agency (IEPA).
    The Motion states that Respondent is not the permitted
    operator of the site at issue; and the Agency is currently
    negotiating with the proper parties. The Motion further states
    that the IEPA and the proper parties have agreed to resettlement
    of a new cause of action providing settlement negotiations
    breakdown.
    The Motion is granted; this action is dismissed.
    IT IS SO ORDERED.
