ORDER OF THE BOARD (by B. Forcade):
On July 19,
1988, Marley—Ingrid
(USA), Inc.
(“Marley—
Ingrid”) filed a second motion for extension
of time within which
to file briefs.
The Illinois Environmental Protection Agency
(“Agency”)
responded
to the motion on July 29,
1988.
On June
21,
1988, Marley—Ingrid filed
its first motion for extension of time
and on June 30,
1988,
the Board agreed
to an extended briefing
schedule while
the Agency and Marley—Ingrid negotiate
a
resolution of
the appeal.
The Agency does not oppose this second
request
for extension,
but merely disputes the due date for its
post—hearing
response.
The motion
is granted and the following
briefing schedule is hereby established.
Marley—Ingrid’s brief
will
be due on September
16,
1988,
the Agency’s response due on
October
17, 1988, and any reply be filed by October
25,
1988.
In addition, Marley—Ingrid has provided
the Board with a
waiver
of decision deadline for
an additional sixty
(60) days.
This case now being due on February 14, 1989.
