ORDER OF THE BOARD (by J.D. Dumelle):
This matter comes before the Board upon Petitioner, America
OTR’s Motion For An Extension Of Time. The motion requests an
additional 60 days to comply with the Board’s Order of July 13,
1988.
Although the motion was timely filed, the motion fails to
address the Board’s Order of July 13, 1988. Specifically, the
motion fails to characterize the docket as a variance, permit
appeal or site—specific rule change as ordered by the Board on
July 13, 1988. The earlier order stated that failure to properly
characterize this docket would result in dismissal.
This action is dismissed without prejudice; Petitioner is
granted leave to refile a properly captioned petition.
