On October 13,
1988 Complainants other
than Bill Aden and
Joe Kendall
(Complainants)
filed a Motion for Limited Rehearing
or Modification of Final Order.
The City of Freeport (Freeport)
did not file
a response to this motion.
However, Freeport filed
a Motion for Stay of the Board’s September
8, 1988 Order on
October
24,
1988.
Essentially, Freeport requests
a stay to the
extent that the Board’s Order imposes a $10,000 civil penalty
pending an appeal by Freeport
in the Illinois Appellate Court,
Second District.
The Board received notice of
this appeal on
October 19,
1988.
Since the Complainants’ motion was filed in
a timely manner,
the Board
has jurisdiction
to act on the motion notwithstanding
Freeport’s appeal which was filed with the Second District on
October 13,
1988.
