is denied as
to all requested
modifications
for the following reasons:

The language chosen
in numbered paragraph
one
is
clearly
not
intended
as
more
limited
than
Petitioners’
requested
“prior
to August
30, 1988”
language;
2..
The language chosen in numbered paragraph
three clearly contemplates “application,”
as requested by Petitioners; and
3..
The Board
is very sensitive
to statutory
deadlines
for decision,
so
it proceeds
to
prompt determination
of
contested
cases
in
which
the
petitioners
have
not
filed
waivers of any such
deadline..
The Petitioners are free
to file
a motion accompanied with
a
waiver
of any statutory deadline that may exist, and the hearing
officer could
then grant
an extension of the briefing
schedule..
