This matter
is before the Board
upon its own motion.
On
January 18, 1989
the United City of the Village of Yorkville
(“Yorkville’t)
filed
a Petition for Extension of Prior Variance.
However,
Yorkville did not submit the appropriate 75 dollar
filing
fee when
the petition was
filed, pursuant
to Section 7.21
of the Environmental Protection Act,
Ill.
Rev.
Stat.
ch.
111 1/2,
Sec.
1001—1052,
(P.A.
85—1331, effective January
1,
1989).
On
January
19,
1989 the Board adopted
an Order stating
that “unless
Yorkville files
a filing fee within
21 days of the date
of
this
Order,
it will be subject
to dismissal.”
To date,
Yorkville has not submitted
the required
filing
fee.
Since
the
21 days
to submit the filing
fee allowed
to
Yorkviile by
the Board
on January
19,
1989 has passed,
the Board
hereby dismisses
this petition.
This does not preclude Yorkville
from filing
a
new
petition properly, by including the
75 dollar
filing fee and correcting
the substantive deficiencies
in its
petition, noted
in the Board’s January 19,
1989 Order.
