    ORDER OF THE BOARD
    (by J. Anderson):
    On March
    20,
    1989, Waste Management
    of
    Illinois,
    Inc.
    (WMI)
    filed
    a motion
    to extend the hearing date
    in this matter until
    after
    January
    1,
    1990,
    and waived the decision deadline
    to April
    30,
    1990.
    The Illinois Environmental Protection Agency (Agency)
    filed
    a response
    in support of WMI’s motion on March
    23,
    1989.
    WMI and
    the Agency are seeking
    to resolve certain closure
    plan
    issues,
    related
    to WMI’s ESL site,
    which are the basis
    for
    this permit denial appeal.
    To this end, WMI has agreed
    to
    develop data and perform analyses related
    to the control
    and
    migration of leachate.
    WMI will submit the results of its investigation/study to
    the Agency on October
    1,
    1989.
    The Board grants WMIs motion.
    The Board
    recognizes,
    as
    noted by the Agency, the long history of litigation involving
    this site, but it
    is also concerned
    about
    the length of time this
    proceeding will be delayed.
    Therefore,
    the Board orders ~‘7MIand
    the Agency to
    file, singly or jointly, a status report no later
    than October
    15,
    1989, particularly with regard
    to the timeliness
    of the submittal
    of the investigation/study and
    its potential
    effect on the resolution of
    the
    issues.
