On November
28,
1988, Morton Thiokol,
Inc., Morton Chemical
Division (Morton Thiokol)
filed
an emergency motion requesting
that hearing
in this matter
be permanently cancelled.
At
its
November
29, 1988 Board meeting,
the Board issued an order
holding that Morton Thiokol’s motion did not constitute
an
emergency,
and held
it for Agency reply.
On November
29,
1988,
the Agency moved to file
its
recommendation instanter, which motion
is granted.
On December
7,
1988,
the Agency filed
its reply and on December
12,
1988 the
Agency stated by letter that
it had subsequently received
a
letter, which
it attached,
on December
5,
1988 from Patricia
A.
r4alo.
Ms. Malo stated that she does not wish
to request hearing
in this matter,
but continues
to express environmental concerns.
After reviewing
the filings, the Board has determined
that,
on balance,
a hearing should be held;
the Board hereby
instructs
the Hearing Officer
to proceed with the hearing scheduled
for
January
6,
1989.
